The Hawaiian Supreme Court has long had a tendency to rule as if Hawaii was still an independent nation-state, rather than one of the 50 United States, notably referring to the island’s “Aloha Spirit” as a reason it need not comply with the Constitution’s Second Amendment, no matter how the US Supreme Court rules on 2A matters.
Well, they’ve just transitioned from being impudent and insubordinate, to being utterly deranged in rebellion against SCOTUS authority.
In ruling on a criminal appeal involving now-questionable hair matching testimony offered in a 1989 sexual assault case that resulted in a 40-year sentence, the Hawaiian Supreme Court actually had an interesting legal question at hand.
Given that the questionable nature of the evidence was learned only 20 years after the conviction, and was believed by all to be reliable at the time offered, should this evidence be treated as “newly discovered”—in which case relief on appeal was unlikely given all the other cumulative evidence of guilt—or should it be treated as “false evidence” mandating a new trial?
Interesting stuff—and the Hawaiian Supreme Court ultimate chooses the second option and grants a new trial, although the appellants sentence was right on the verge of the end of his 40-year sentence.
That’s not the crazy part, however. The crazy part is that the Hawaiian Supreme Court spent nearly 10 pages of this opinion going completely off the rails of the facts and law of this appeal, and spending those pages absolutely EXCORIATING the US Supreme Court and its last several years of jurisprudence in particular and its commitment to originalism generally.
As far as the Hawaiian Supreme Court is concerned, SCOTUS is nothing but Right-wing Fascist trash, trash, trash, and they are not holding back in sharing their feelings on the matter.
