On May 3, 2024 Deputy Eddie Duran was called to the Elan Apartments in Okaloosa County Florida in response to a domestic violence call. The events were captured on his body worn camera, which we’ll watch in today’s show.
Upon arrival Duran was informed of an apparently increasingly violent confrontation occurring in one of the apartments—sadly, he was sent to the incorrect unit.
Reaching the unit knocked on the door, announced himself as law enforcement, and waited. Within moments the door opened to reveal a young black man holding a pistol at his side in his right hand.
Duran drew and shot him dead.
That man would turn out to be an utterly law-abiding US Airman named Roger Fortson, and now former-deputy Duran is facing trial for that killing.
A short while ago the court held a self-defense immunity hearing, often mistakenly referred to as a “stand-your-ground” hearing, by which a defendant claiming self-defense can hope to be immunized against prosecution. Ultimately, this attempt at immunity was rejected by the court, and Duran’s trial is now expected to begin September 29.
That said, there was some very interesting testimony in that hearing, including from two world-class use-of-force experts retained by the defense—Von Kliem and Massad Ayoob, both personal friends of mine.
Of particular interest, however, is that the defendant, Eddie Duran, took the stand under oath and testified in his own defense.
In today’s show we’ll break down the testimony of Duran, and in follow-up shows we’ll cover the expert witness testimony of first Von Kliem and then Massad Ayoob.
