Public attention, and animosity, is exploding towards FLOCK mass surveillance cameras, directly in parallel with their explosive growth across the country.
These Flock cameras are presented by their fans as useful tools to law enforcement, facilitating the ability to track and capture criminals.
Actual Americans, on the other hand, are disinclined to agree to live under a constant state of effective government surveillance previously imaginable only to George Orwell as a cautionary tale and Communist dictatorships as a matter of public policy. After all, the 4th Amendment is supposed to secure American citizens against unreasonable searches.
The US Supreme Court has not yet had the opportunity to rule on the constitutionality of Flock cameras, per se, but they have in recent years had a couple of cases involving other modern-day data tracking of persons by law enforcement, and those decisions have favored protecting the boundaries of the 4th Amendment in the interests of American’s privacy expectations.
That said, you might be surprised to learn that the justices in the dissent of those decisions—the ones who might, if those decisions are extended to Flock cameras, argue that the cameras do NOT violate the 4th Amendment, are not the justices you might have expected.
Join me as we take a look at those two prior SCOTUS decisions in Carpenter v. US and Chatrie v. US, and see if they provide us with insight as to how SCOTUS might address the Flock invasion.
