On May 13 of this year Dalton “Chud the Builder” Eatherly, a white man, was leaving the Montgomery County Courthouse in Clarksville, TN—outside of Nashville—when he had a brief verbal exchange with Joshua Fox, a black man.
Eatherly had made something of a reputation of himself for routinely making racially provocative comments in his social media content, content with which Joshua Fox may have been familiar, but there exists zero evidence that he engaged in any such provocation with respect to Fox that evening.
After Eatherly had separated from Fox and was walking way, Fox abruptly charged after Eatherly, attacking Eatherly and placing him in a headlock. Eatherly drew a pistol, and fired while in the headlock, hitting Fox, missing Fox, and even injuring himself with a round.
Rather than Fox being charged with felony assault and battery, it was Eatherly who found himself charged with attempted murder for having shot Fox, and reckless endangerment with a dangerous weapon for having missed Fox.
After his arrest Eatherly found himself being held on a bond of $1.25 million, vastly greater than that typically set in that district even for murderers of children. Although that bond was then slightly reduced to an even $1 million, the judge also required that the bond be distributed among ten distinct bail bondsmen, so that none had an exposure greater than $100,000. This greatly complicated securing bond.
Yesterday, however, Eatherly managed to secure bond and his release.
