The Supreme Court yesterday delivered a body check to almost two-dozen unelected, black-robed, tyrannical, inferior, federal district court judges who were blocking the Trump’s administration to put the “temporary” in “Temporary Protected Status” (TPS) for hundreds of thousands of third-world migrants who have been living in the United States for years, sometimes decades.
Although there is an explicit Article I Legislative Branch statutory bar that prohibits the Article III Judicial Branch courts from second-guessing the TPS determinations of the Article II Executive Branch officers, the inferior judges dishonestly sidestepped this prohibition by claiming they weren’t second-guessing the SUBSTANCE of the executive decisions, but merely the PROCEDURE by which the executive made its decisions.
It’s not WHAT you’re saying, it’s HOW you’re saying it! This facially ridiculous argument was made by nearly two-dozen inferior judges, including in the particular case of the Haitian case reviewed by SCOTUS, Judge Ana Reyes who was not even born in the United States.
Justice Samual Alito authors the majority opinion, with a powerful concurrence by Justice Clarence Thomas, and we break it all down! We may also briefly address the silly arguments of the dissents written by the three SCRONES, Kagan, Sotomayor, and Jackson.
