The nation anxiously awaits the Supreme Court’s decision on whether the 14th Amendment grants birthright citizenship not just to children born on US soil to American citizens and lawfully present permanent resident aliens, but also to children born on US soil to transient visitors, birth tourists, and outright illegal invaders.
I’ve covered this topic since immediately after Trump issued his executive order denying US citizenship documents to children born on US soil to sojourners and invaders, and of course that’s exactly the correct understanding of the 14th Amendment.
Despite that correctness, there’s no certainty that the Supreme Court will arrive at the correct legal conclusion, given that at least a third of the judges are hard-core Progressives, with two of those being essentially retarded, and several other justices being too easily emotionally swayed away from law and facts in order to prevent hurting people’s feelings.
Nevertheless, the understanding of the 14th Amendment I’ve shared with all of you time and again, supported by law and history and common sense and national survival, remains the correct understanding.
And while I don’t like basing arguments on appeals to authority, when I’ve already made the correct legal argument on the legal merits many times, it doesn’t hurt to have a well credentialed legal mind as back up on that correct legal argument.
And that’s what we’ll do today—a legal essay on the correct understanding of the 14th Amendment written by law Professor Philip Hamburger, who previously teaches at Columbia Law Schook, previously at the University of Chicago Law School, as well as George Washington Law School, and elsewhere.
