Yesterday the Supreme Court heard oral argument on the question of whether the federal statute stripping Second Amendment gun rights from habitual users of marijuana was constitutional.
In an exchange with the government lawyers arguing in support of the law, Gorsuch pointedly noted that our Founders drank a great deal by modern-day standards, and asked whether by the standard of this marijuana statute the Founders themselves would have been stripped of their Second Amendment rights?
AWKWARD!
Any restriction of any American’s Second Amendment rights—a right obviously and explicitly enumerated in the Constitution’s Bill of Rights—should obviously be subject to the highest degree of scrutiny—we all know the gun grabbers, given an inch, will take a mile. If today it’s marijuana, will it be alcohol tomorrow? Anti-depressants? Diagnosed PTSD?
