America’s 14th Amendment “birthright citizenship” clause has long been applied far more broadly than the history & tradition of the nation warrant—or the intent of the men who wrote, debated, and ratified that clause intended.
The notion that a person born on American soil automatically secures American citizenship is plainly nonsense if the 14th Amendment is properly understood—and, indeed, it is cultural self-ending if permitted to continue, especially at scale. In fact, a baby born on American soil becomes a US citizen only if at least one parent is themselves a US Citizen or at least a permanent resident alien. Children born on US soil to parents both of whom are merely present transiently—such as on a tourist, student, or work visa—or worse yet here illegally, does not automatically secure for itself American citizenship.
Although third-world migrants have long used the mistaken understanding to bear so-called “anchor babies” on US soil, claim those babies to be US citizens, and then use the baby’s purported status as a US citizen to prevent their own deportation. Such a tactical abuse of the misconception of birthright citizenship already severely damages America’s social fabric, and degrades the value of US citizenship, our nation’s most precious resource.
China, however, has taken this abuse of the misconception of birthright citizenship to a strategic level that promises the annihilation of America as a unique body politic and culture. By systematically flying in pregnant Chinese women onto American soil simply to give birth, then immediately flying the woman and child back to China, China has now secured a population of perhaps a million cultural Chinese with a false claim to American citizenship—and those million paperwork American citizens will soon be old enough to vote, and vote decisively in American elections.
Today Attorney Jude Stone filed an amicus brief with the US Supreme Court in the upcoming birthright citizenship case before the court – Trump v. Barbara – over Trump’s Executive Order, “PROTECTING THE MEANING AND VALUE OF AMERICAN CITIZENSHIP,” setting out this strategic birthright citizenship threat to the United States presented by China, and arguing that the Supreme Court must return birthright citizenship to its proper limits or the United States is doomed to become a suzerain or colony of China.
